    The Brazilian Supreme Court recently handed down a landmark constitutional decision on Brazilian Patents. The case challenged the legal provision establishing a minimum period of patent protection of 10 years counted from the date of grant. By a 9-2 majority, the Court decided that the challenged provision violates the Constitution. Our expert panel looks forward to welcoming you to discuss the changed environment for patents in Brazil and what this means in practice.

    Rule in force from 1996 to 2021:
    Section 40. A patent shall be in force for 20 years counted from the filing date
    Sole paragraph. The term of validity shall not be inferior to 10 years counted from the date of grant
    • In May Supreme Court decided to invalidate the 10-years-from-grant provision
    • Court decided that, as a general rule, this decision should not affect patents that have already granted in Brazil...
     ...EXCEPT FOR (i) pharma/medical patents, and for (ii) patents that were already being challenged in court, which would have their term of protection reduced from 10 years from grant to 20 years from the filing date

    Note: OpenPSV (Patent Scope Visualization) has been collaborative [capstone] project between Harvard Extension School (Khalid Aliwen, Santiago Iraola, Alexander Park, Anna Romanova, Parvinderjit Singh, Trisha Singh (Harvard ES) and Pfizer (Raquel Alvarez ["client",J.D.,Ph.D., Assistant General Counsel], Roman Burdakov, Peter V Henstock). The code and a brief description for OpenPSV is available at github.com. ("The OpenPSV provides an all-inclusive automated analytical pipeline for epitope-based claims. The system automatically stores and processes uploaded patents [selected as a result of separate patent searches] using computer vision, text mining, and sequence alignment techniques. The claimed epitope sequences are aggregated in a visualization chart that is accessible to users.". "... OpenPSV extracts data and metadata from the patents, sequence listings, USPTO API [for sequences], Lens.org API [patent info], Clustal Omega [multiple sequence alignment] package, integrates data processing, data analytics, and visualization tools..."
